Energy Solutions Engineering Group Limited Warranty

All Energy Solutions Engineering Group branded products are warranted against defects in materials or workmanship under normal use for three (3) years from date of purchase of the product from Energy Solutions Engineering Group. This warranty is between the end user and Energy Solutions Engineering Group Any product which is determined by Energy Solutions Engineering Group’s manufacture to be defective in material is determined by Energy Solutions Engineering Group and which is returned to Energy Solutions Engineering Group, shipping costs prepaid, will be repaired or replaced at Energy Solutions Engineering Group 's option. The repaired or replaced product will be shipped prepaid by Energy Solutions Engineering Group to the end user. Energy Solutions Engineering Group shall not be liable for any failure of a product resulting in whole or in part from Acts of Nature; damage caused by failure to provide a suitable installation or operating environment for the product; damage caused by impact with other objects, dropping, falls, spilled liquids, or immersion in liquids; misapplication, abuse, electrical or mechanical conditions not directly created by the product; incorrect installation; or any other circumstances or cause beyond the control of Energy Solutions Engineering Group in the conduct of its business. During the warranty term replacement products may be provided by Energy Solutions Engineering Group and shall be either new or reconditioned or reassembled products which are replacement products may be provided by Energy Solutions Engineering Group and shall be either new or reconditioned or reassembled products which are substantially equivalent to the originally installed product in function and performance and be warranted for the remainder of the original warranty or thirty (30) days from the date of shipment of the replacement product, whichever period is greater. Purchasing any additional products from Energy Solutions Engineering Group does not extend this warranty period. This warranty is not transferable.

Linear Lamp & Ballast System Warranty

Energy Solutions Engineering Group uses specific lamps (operated by specific ballasts) and specifically chosen ballasts, are warranted from the date of delivery to be free of defects in material and workmanship for
the periods shown below. Energy Solutions Engineering Group will, at its option, replace or repair any defective Energy Solutions Engineering Group sold ballasts or any defective Energy Solutions Engineering Group sold lamps operated by Energy Solutions Engineering Group sold ballasts,
returned to Energy Solutions Engineering Group or its distributors freight prepaid.

Combination Energy Solutions Engineering Group Lamp and Ballast System Limited Warranty

If Energy Solutions Engineering Group is satisfied that the lamp models listed below fail to operate or were in fact defective within the warranty period, Energy Solutions Engineering Group will provide free replacement
lamps (but not labor allowance). If Energy Solutions Engineering Group is satisfied that the ballast models listed below fail to operate or were in fact defective within the warranty period, Energy Solutions Engineering Group will pay actual and reasonable labor expenses for the replacement of failed or defective ballasts up to a maximum of $20.00 per ballast in the first year and up to a maximum of $10.00 per ballast in the remaining 4 years.

Terms and Conditions

This warranty is not applicable to any product sold by Energy Solutions Engineering Group, which is not installed and operated in accordance with:
The National Electric Code (NEC); The Standards for Safety of Underwriters Laboratories, Inc. (UL); The Standards of the American National Standards Institute (ANSI); The specific instructions provided by Energy Solutions Engineering Group for the installation of the product(s). This warranty is also not applicable if the system, lamp and ballast, is operated in abnormal operating conditions: minimum operating temperature 0°F, maximum operating temperature 100°F; 24,000 hours based on 3 hour cycle; not for use with dimmers, timers, motion sensors, or other control devices; operating out of the recommended operating voltage, excessive operating hours or switching cycles, improper lamp and ballast installation, or dirty or cracked sockets. The lamp portion of this warranty is not applicable if the Energy Solutions Engineering Group sold lamps are replaced with any other manufacturer’s lamp. This entire warranty is not applicable if the Energy Solutions Engineering Group sold ballast is replaced with other manufacturer’s ballast.

Replacement of Product, Limit of Liability
The forgoing shall constitute the sole remedy of the purchaser and the sole liability of Energy Solutions Engineering Group. With regard to warranty Energy Solutions Engineering Group makes no other warranty, statutory
or otherwise, and none is implied. No warranty of merchantability of fitness for a particular purpose is made or is to be implied. Energy Solutions Engineering Group will not, under any circumstances be liable for special or consequential damages including, but not limited to, the loss of profits or revenue or good will,
loss of use of ballasts or any other goods or equipment, or facilities, cost of capital or storage or inspection, cost of substitution equipment, downtime costs, or claims of customers or purchase from such damage.

WARRANTY DISCLAIMER

The Limited Warranty stated above is the only warranty applicable to the product. The laws in some jurisdictions, however, do not allow the exclusion of implied warranties. If these laws apply, then all express and implied warranties are limited in duration to the three-year limited warranty period listed above; no warranties apply after that period. No oral or written information or advance given by Energy Solutions Engineering Group, its agents, assigns, distributors, or employees shall create a warranty or in any way increase the scope of this Limited Warranty.

LIMITATION OF LIABILITY

Any liability for consequential and incidental damages is expressly disclaimed. The liability of Energy Solutions Engineering Group in all events is limited to and shall not exceed the published manufacturer's suggested list product price.

PROMPT DISPOSITION

Energy Solutions Engineering Group will make a good faith effort for prompt correction or other adjustment with respect to any product which proves to be defective within the warranty period. Before returning any product, contact Energy Solutions Engineering Group to obtain a Return Materials Authorization (RMA) number. All warranty returns must be in accordance with the following procedures:
